1. Acceptance of Terms

By downloading, installing, or using Vibe Decode ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Vibe Decode is developed and operated by Terrance Gomez E, an individual developer ("we," "us," or "our"). These Terms are an agreement between you and Terrance Gomez E. Vibe Decode is a mobile application that provides:

AI-powered analysis of text messages and relationship situations you describe
Relationship tracking and pattern analysis
An AI chat feature for relationship guidance

The App is intended for entertainment and informational purposes only.

3. User Accounts

3.1 Account Creation

You must provide accurate and complete information when creating an account
You are responsible for maintaining the confidentiality of your account credentials
You must be at least 18 years old to use the App

3.2 Account Security

You are responsible for all activities under your account
Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Terms

4.1 Free Tier

A limited monthly allowance of decodes (messages and situations)
A limited number of planets (connections) in your galaxy
Access to core features

4.2 Paid Subscriptions

Plus Plan, $4.99/week or $51.99/year: higher monthly limits for decodes, deep analyses, chats, and connections, plus extended decode history.
Pro Plan, $7.99/week or $79.99/year: everything in Plus, with the highest monthly limits and full decode history.

The specific limits for each plan (decodes, deep analyses, chats, connections, and decode-history retention) are shown in the app and may change from time to time; the limits displayed at the time of purchase apply to your subscription.

4.3 Billing

Subscriptions are billed through Apple App Store or Google Play Store
Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription price
If a paid plan includes a free trial, the trial length depends on the plan you choose (some plans may not include a trial and are billed at purchase) and is shown at the point of purchase before you confirm; you will be charged the plan's price when the trial ends unless you cancel at least 24 hours before
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
Refunds are handled according to the respective store's policies (Apple App Store refund policy or Google Play refund policy)

4.4 Managing and Cancelling Subscriptions

You may cancel your subscription at any time
On iOS: Go to Settings > [your name] > Subscriptions > Vibe Decode > Cancel Subscription
On Android: Go to Google Play Store > Menu > Subscriptions > Vibe Decode > Cancel Subscription
Subscriptions may be managed by the user, and auto-renewal may be turned off by going to the user's Account Settings after purchase
Cancellation takes effect at the end of the current billing period
No refunds for partial subscription periods

5. Acceptable Use

You agree NOT to:

Use the App for any illegal purpose
Harass, abuse, or harm others using the App
Upload malicious content or attempt to compromise the App's security
Use the App to stalk, harass, or invade the privacy of others
Share content that is defamatory, obscene, or offensive
Attempt to reverse engineer or copy the App
Use automated systems to access the App
Violate any applicable laws or regulations

6. Content Guidelines

6.1 Your Content

You retain ownership of content you submit to the App
By submitting content, you grant us a license to process it for service delivery
You are responsible for ensuring you have the right to share any messages you decode
Third-Party Data: By adding a person to your Galaxy, you represent that you have a reasonable basis to share their name, optional zodiac information, and message content with Vibe Decode for analysis. You confirm that you either have their consent or a lawful basis (such as your own rights as a message recipient) to share their communications

6.2 AI-Generated Content

Decode results and advisor responses are generated by AI
AI outputs are for entertainment and should not be considered professional advice
We do not guarantee the accuracy of AI-generated content

6.3 AI Processing Consent

Certain features of the App (message decoding, situation decoding, the AI chat feature, deep analysis) use OpenAI, a third-party AI provider, to process your data
Before using AI-powered features, you will be asked to provide explicit consent for data processing
You may revoke this consent at any time through Settings > Data & Privacy, which will disable AI-powered features
By consenting, you acknowledge that your data (including message text, optional zodiac context, relationship context, and chat history) will be sent to OpenAI for processing in accordance with OpenAI's privacy policy
We do not control and are not responsible for OpenAI's data handling practices; please review OpenAI's Privacy Policy

6.4 Content Moderation

The App includes AI-powered features (message decoding, situation decoding, the AI chat feature, deep analysis) and lets you submit content, including the messages and situations you choose to decode. To maintain a safe environment:

We have zero tolerance for objectionable, abusive, harassing, or otherwise inappropriate content or behavior.
AI-generated responses are filtered server-side for harmful, abusive, or inappropriate content
You can report objectionable content using the in-app reporting feature available on every AI surface
We review every report and remove flagged content, and eject the offending user where warranted, within 24 hours.
We reserve the right to moderate, restrict, or remove any content that violates these Terms or community standards, and to suspend or terminate accounts that do so

7. Intellectual Property

7.1 Our Rights

The App, including its design, features, and content, is owned by Terrance Gomez E, the developer of Vibe Decode
Our trademarks, logos, and branding may not be used without permission

7.2 Your Rights

You retain ownership of personal data and content you provide
You may export or delete your data at any time

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability or fitness for a particular purpose
Accuracy or reliability of any information provided
Uninterrupted or error-free operation
Compatibility with your device

IMPORTANT: Vibe Decode provides entertainment-based insights. Our analysis should not be used as the sole basis for relationship decisions. We are not a substitute for professional counseling or therapy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the App in the past 12 months
We are not responsible for decisions made based on App insights

10. Indemnification

You agree to indemnify and hold harmless Terrance Gomez E, the developer of Vibe Decode, from any claims, damages, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights

11. Modifications to Service

We reserve the right to:

Modify or discontinue features at any time
Change pricing with reasonable notice
Update these Terms (continued use constitutes acceptance)

12. Termination

12.1 By You

You may stop using the App and delete your account at any time

12.2 By Us

We may suspend or terminate your access for violation of these Terms
We may terminate the service with reasonable notice

12.3 Effect of Termination

Upon termination, your right to use the App ceases
Provisions that should survive termination will remain in effect

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, contact us to attempt informal resolution

13.2 Arbitration

Disputes shall be resolved through binding arbitration
Class action waiver: disputes must be brought individually

13.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Third-Party Platform Acknowledgments

15.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

These Terms are between you and Terrance Gomez E only, and not with Apple Inc.
Apple has no obligation to furnish any maintenance and support services with respect to the App
Terrance Gomez E, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims
Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes a third party's intellectual property rights
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary

15.2 Google Play Store

If you downloaded the App from the Google Play Store, you acknowledge that Google LLC is not a party to these Terms and has no obligations or liability to you with respect to the App.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Terrance Gomez E concerning Vibe Decode.
